Amended Practice Direction for Civil Applications Motions and other Matters in the Toronto Region - Matters Before Masters

The Practice Directions for Motions before a Master from the Class Proceedings, Commercial and Estates List in the Toronto Region are supplemented to provide the authority to a case management master to hear motions to a registrar under the Bankruptcy and Insolvency Act without a written direction from a judge, commencing January 30, 2012.

To effect that change, paragraph 18 of the referenced Practice Direction will provide:

(iii) Motions before a Master from the Class Proceedings, Commercial and Estates Lists

[18] If the motion is under the Class Proceedings Act, 1992, or a proceeding on the Commercial List or Estates List, a written direction will be required from a judge on the respective list permitting the motion to be heard by a master. Similarly, if the action has been assigned to a judge under rule 37.15 or rule 77.06, a direction from that judge that a master be appointed to hear motions within the master’s jurisdiction will be necessary. The requirement for a judge’s written direction does not apply to motions under the Bankruptcy and Insolvency Act heard by a master exercising the authority of a registrar of the court in bankruptcy under that Act.
